A lawyer for Blac Chyna claimed victory after a judge tentatively ruled on Thursday on an attempt by Kim Kardashian and Kris Jenner to be removed from a lawsuit.
‘We won at the hearing today,’ said Lisa Bloom, an attorney representing Chyna.
Chyna sued the Kardashian family in October claiming the family sabotaged her E! reality show with ex-fiance Rob and ruined her brand.
Court: A judge tentatively dismissed Kim Kardashian and mother Kris Jenner from a lawsuit Blac Chyna filed against them last year claiming they sabotaged her E! reality show with ex-fiance Rob, but allowed Chyna’s lawyers to amend their complaint with more allegations
Kardashian and Jenner lawyers Shawn Holley and Patricia Millet squared off against Chyna’s attorneys Bloom and Vanessa Hooker in court in a pre-trial hearing.
According to TMZ, the judge reacted to Chyna’s claim that E! dropped the reality show Rob & Chyna because the Kardashians painted her as a bad mother.
After confessing he’s never watched the show the Judge Randolph M. Hammock said that it would be ‘hard to imagine E! wouldn’t do a show where the woman is a bad mother’.
Court battle: A judge took the Kardashians’ side and said even if they painted Chyna, shown earlier this month, as a bad mother that wouldn’t stop E! doing a show about it
The judge also disagreed with Chyna’s claim that the Kardashians interfered with her contract with E! stating that she was only in negotiations with the network and didn’t have an enforceable contract in place.
‘There was no enforceable contract to have a second season. When there’s no contract, Blac Chyna did not have a right to have a second season,’ said Hammock during the hearing.
A ‘demurrer’ was filed in December by Holley and Millet objecting to and asking for a dismissal of the lawsuit against Kris and Kim.
No reality show: The judge also said that Chyna’s claims the Kardashians interfered with her E! contract didn’t stand because she was only in the negotiating stage with the network
Hammock in a tentative ruling wrote in court documents, ‘Defendants Kris Jenner and Kim Kardashian West’s demurrer to the first amended complaint is sustained.’
The judge however also granted Bloom and Hooker with another chance to amend their complaints in the lawsuit with additional allegations.
They are still in the lawsuit, Rob, Kris and Kim. I think it’s a victory for us because the judge is allowing us to include additional allegations. …We think we have strong claims against the family,’ Bloom said.
Bloom admitted to ‘deficiencies’ in the drafting of the complaint, but said they would move forward with the lawsuit.
In Chyna’s original lawsuit she named the whole Kardashian clan, including Khloe, Kendall, Kylie and Kourtney but ended up amending it to go after just Kris, Kim and Rob
‘This was their attempt to have some of the issues dismissed because they alleged we didn’t properly plead them. So the judge gave us leave to amend, which means the judge is allowing us to do another version of the complaint to add some allegations,’ Bloom told reporters according to People.
[The Kardashians] will then probably come back and say it’s still not sufficient and we’ll probably be back and argue it again,’ she added.
Patricia Millet, who also is an attorney for Kardashian and Jenner, said: ‘ We don’t think they can fix it’.
Hitting back: Chyna is still suing Rob – but he maintains that the show was canceled because she got a restraining order against him and it’s not possible to do a reality show together when they can’t interact
The lawsuit claiming defamation and intentional interference of contractual relations alleges the family killed the E! reality show Rob & Chyna after she broke up with him.
Bloom said that season two was green lit by E!, the network announced it and Chyna, Rob and the production company all agreed to do the show.
‘The family we allege then decided to come after her and kill the show and that’s what they did,’ Bloom said.
Chyna is still suing Rob – but he maintains that the show was canceled because she got a domestic violence restraining order against him and it’s not possible to do a reality show together when they can’t interact.
The civil lawsuit also accuses Rob of battery, assault, distribution of private sexually explicit materials, domestic violence, harassment and intrusion into private affairs for posting nude pictures of her online as well as personal medical information.
The news comes days after Kim, Kris and Rob hit back at the former stripper saying her claims are ‘bald conclusions that have no factual support.’
Chyna was said to be fuming according to TMZ, after the Kardashian clan asked the judge to toss the case because they said she is responsible for the cancellation after she got a restraining order against Rob.
TMZ’s insider says that Chyna is mad because she thinks a woman shouldn’t lose her job because of trying to protect her and her family from violence, adding that she had ‘fears’ for her and daughter Dream’s safety.
Will she try again?: The former stripper, who also claims Rob abused her, has been given permission to create a new case against Kim and Kris
Chyna, who also claims Rob abused her, thinks the Kardashian clan are sending a bad message to women who get domestic violence restraining orders.
However, after Rob agreed to pay her $ 20,000 monthly in child support for their daughter Dream, Chyna dropped the restraining order; which shows she didn’t really feel threatened, according to TMZ via a Kardashian source.
The Kardashians, according to a TMZ report on Wednesday, claim that the former exotic dancer is the only party responsible for the Rob & Chyna show cancellation.
Their reasoning is that when she filed for the restraining order against Rob, it made it impossible to shoot any scenes of her with him.
According to Chyna – whose real name is Angela White – the US TV network E!, the show’s production team and Rob were all open to shooting a second season before it was suddenly cut, and she believes the trio were responsible for the cancellation.
Chyna – who also has five-year-old son King Cairo with her ex-fiance Tyga – has also accused the Kardashians of defamation, after they alleged that she left Dream at home while she went to a party, but the Kardashians insist they never made that claim.
Rob and Chyna started dating in January 2016 – the same year they got engaged and also welcomed their daughter Dream, now 13 months. They were on-off until they broke off their relationship in February 2017.
It seemed Chyna was ready to bury the hatchet this week as she offered kind words to former friend Kim after the birth of her third child with husband Kanye West.
Speaking to The Blast , Chyna said of the news while flashing a beaming smile: ‘It’s always a blessing. They deserve blessings.’
